中 文 摘 要

    隨著改革開(kāi)放步伐的加快，我國(guó)國(guó)民經(jīng)濟(jì)進(jìn)入快速發(fā)展時(shí)期。在這種特殊的歷史條件下，一種新型經(jīng)濟(jì)犯罪活動(dòng)呈日趨上升態(tài)勢(shì)，即打著各式新型營(yíng)銷(xiāo)旗號(hào)，利用傳銷(xiāo)和變相傳銷(xiāo)手段犯罪。傳銷(xiāo)已經(jīng)在全國(guó)范圍內(nèi)蔓延，這種犯罪活動(dòng)的出現(xiàn)嚴(yán)重?fù)p害人民群眾的利益，同時(shí)嚴(yán)重干擾正常的社會(huì)活動(dòng)秩序。由于傳銷(xiāo)和變相傳銷(xiāo)犯罪活動(dòng)具有較大的欺騙性、隱蔽性，對(duì)國(guó)家的社會(huì)和經(jīng)濟(jì)發(fā)展具有極大的危害，影響社會(huì)穩(wěn)定。因此，從中央至各級(jí)地方政府及公安機(jī)關(guān)對(duì)此類(lèi)犯罪非常重視。出臺(tái)相關(guān)法律法規(guī)，每年開(kāi)展專(zhuān)項(xiàng)行動(dòng)。但是打擊傳銷(xiāo)卻陷入“打而不絕反猖獗”、“屢禁不止、屢打不盡”的怪圈，形成“傳銷(xiāo)人員執(zhí)迷不悟→政府打擊遣散效果不明顯→執(zhí)法人員麻木熱情不在→百姓求助無(wú)門(mén)遭拒絕→傳銷(xiāo)更加猖獗”的惡性循環(huán)。

    本文從實(shí)際出發(fā)淺析此類(lèi)犯罪形成、特點(diǎn)，分析當(dāng)前打擊傳銷(xiāo)制度上的缺陷：在法律層面上，處罰過(guò)輕缺乏震懾力、法律程序上取證認(rèn)定難；在行政執(zhí)法體制方面，打擊格局不對(duì)稱(chēng)、協(xié)作機(jī)制不健全、執(zhí)法隊(duì)伍專(zhuān)業(yè)水平欠缺、行政執(zhí)法缺乏積極主動(dòng)性；其它相關(guān)政策中，宣傳預(yù)防工作不深入、思想教育和改造措施缺失。通過(guò)上述分析，本文提出打擊和預(yù)防對(duì)策。從宏觀上：完善立法，做到有法可依、權(quán)責(zé)分明，依法行政、加強(qiáng)行政監(jiān)督，建立通報(bào)制度、建立健全宣傳預(yù)防和思想矯正系統(tǒng)；從微觀上：建立政府部門(mén)的協(xié)調(diào)機(jī)制、充分動(dòng)員全社會(huì)力量、建立打擊傳銷(xiāo)長(zhǎng)效機(jī)制。從而實(shí)現(xiàn)“依法嚴(yán)打、依法嚴(yán)懲→思想解救、教育改造→深入開(kāi)展宣傳預(yù)防→全民參與、營(yíng)造反傳銷(xiāo)氛圍”的良性循環(huán)。

The Research on the Present Policy about

Striking the Crime of Pyramid Sales

Abstract

    With the pace of reform and opening-up getting faster，the national economy enters a stage of rapid development. And a new kind of economic crime is increasing gradually under this special historical condition，that is，it commits a crime with the means of pyramid selling and converted pyramid selling and with the banner of new type of marketing. Pyramid selling also spreads throughout China，which does great harm to people and affects the order of social activities. At the same time，pyramid selling and converted pyramid selling are bad for social progress and economy development because they have the characteristic of fraudulence and concealment and have an impact on social stabilization. Therefore，government and police from head to heel pay much attention to this kind of crime. All the governments promulgate related laws and regulations and wage special striking actions every year. However, the action of striking pyramid selling formed a strange phenomenon that the pyramid selling has become much more rampant rather than extinguish after the special actions and the pyramid selling is still developing through prevention and still exists through the striking actions. What’s more, the action is in a vicious recycle that is the pyramid selling attendants are not willing to come to their senses, the governments haven’t got a distinct effect of strike and demobilization, the law enforcement officials have been numbed and lost their enthusiastic, the masses are rejected and can’t find the correct way to save their relatives or friends and the pyramid selling becomes more and more rampant..

    This thesis analyzes the form and feature of this crime on the basis of reality and the shortcomings in the laws of striking the pyramid selling: 1) from the view of laws, the punishment is too light to form any deterrence for others and the collection of evidence in the legal process is very difficult; 2) from the view of the system of law enforcement, the striking structure is not balanced; the system of cooperation is not perfect; the professional knowledge of the law enforcement officials is insufficient; the administrative enforcement officials is not positive initiative in taking actions . In other related policies, the job of publicity and prevention do not penetrate deeply and the measures of mind education and improvement are not sufficient. From the above analyze, the thesis provides the methods of strike and prevention. In macro-scale, we should perfect legislation in order to perform the duties in accordance with laws and have a clear division of rights and responsibilities. And we should perform its official duties according to laws. Besides, it is necessary for us to enhance the administrative supervision, and set up the report institution and establish and improve the systems of publicity and prevention and mind rehabilitation. In the micro-scale, the government should establish the cooperation system among departments and fully mobilize all the people, and set up the permanent mechanism of striking pyramid selling so as to realize the virtuous circle of strictly striking pyramid selling and punishing the criminals according to laws, correcting their minds and educating and reforming them, carrying out the publicity and prevention deeply and participating of the whole nation to create a supportive atmosphere of anti-pyramid selling.
